CALL TO ORDER
The meeting was called to order by chairman Robert Fazen at 7:05 p.m. in Council Chambers, 230 Hamilton Street.
ROLL CALL
Present were: Mayor Ryan, Mr. Thompson, Mr. Gaglia (arrived at 7:20), Mr. Sabatino, Mr. Fazen, Mr. Shive (arrived at 7:25), Mr. Fasanello and Mrs. Pournaras.
Also present were: Mrs. Malone, recording secretary; Mr. Rodgers, board attorney; Mrs. Doyle, planner; and Mr. Cilo, engineer.
COMPLIANCE STATEMENT
This meeting is being held in compliance with the “Open Public Meetings Law.”
The requirements of the Law have been met. The Special Meeting Notice has been posted in the Municipal Building, filed with the Municipal Clerk, and forwarded to the Bound Brook Chronicle on March 20, 2003.

Adoption of amendment to the Housing Element of the Master Plan of the Borough of Bound Brook
Adoption of a Fair Share Plan as part of the Housing Element of the Master Plan of the Borough of Bound Brook
Mrs. Doyle addressed the above matters. This is a document required for substantive certification by COAH. Our original obligation, round 1 and 2, requires 33 rehabilitation units.
In a letter from Mr. Soriano dated March 31, 2003 there was an indication of some confusion. The first item indicated there was no description of what constitutes affordability (it can be found on page 70). The rest of the bullets are issues that relate to accessory apartments, ordinances for new construction, etc. This project does not need construction. Mrs. Doyle found deed restricted properties that applied for critical structural and other improvements. Mr. Brodbeck has done an outstanding job - he has 47averaging $8000 per unit. Mrs. Doyle handed out another $15,000 unit, modifying the plan. She asked that anyone with sheet #11 remove it from their packet; it will be replaced. The name, block and lot of a battered women's home is on this page, and it should not be advertised as to its location, so the page will be replaced.
The rest of Mr. Soriano's comments relate to ordinances in the plan; there is no need for ordinances because they were given more than 6 years ago and are confirmed eligible. Mrs. Doyle recommended a vote after any comments from the board and the public.
Mr. Fazen thanked Mrs. Doyle and Mr. Brodbeck for their work
Motion by Mrs. Pournaras, seconded by Mr. Thompson, to approve. Unanimous.
Mr. Rodgers has a resolution to be signed this evening.
Adoption of a Re-examination Report of the Master Plan of the Borough of Bound Brook.
Mr. Fazen noted that Mr. Bzik's letter stated that “prior to full implementation of the ordinance an updated Historic Survey as well as adoption of the downtown study by Ford, Farewell, Mills and Gatch should be conducted.” A full ordinance does address all those issues. We have had the re-examination report for two years, and Mr. Fazen asked if there were any comments. Mrs. Doyle said the ordinance brings in Ford, Farewell, Mills and Gatch and added a Kitchen Associates document that will aid the historic body.
The historic preservation ordinance was sent to the mayor and council for review and, hopefully, approval in the near future. The board has volunteered to discuss it with the council at their convenience. They feel strongly that the borough needs such an ordinance in place as the only way to save some valuable borough assets.
If it is approved, Mr. Fazen indicated he hopes the mayor will be able to appoint the five-person commission the same night so they can get to work. Nothing is done without the council's approval; it is an advisory board. There are funds available from the county, state and federal governments. The ordinance stands alone; the Master Plan is another issue. Both will be aired in public. The governing body will go through the Master Plan and revise it as they see fit. The parking ordinance is not yet finalized.
Linda Brnicevic, 20 Talmage Avenue, asked if the document will be passed on to the council and asked if there will be a public hearing. She was assured that copies will be available from the main window in Borough Hall. Mr. Brodbeck explained that there will be a copying charge for copies to be taken from borough hall.
Mrs. Doyle explained that the council will receive the document and must have a public hearing if they want to pass it. Ed Gabrielski asked if this is the only chance the public has to review the Master Plan. Mr. Fazen explained it has been discussed for two years. It will go to the council after this meeting.
Mr. Reina explained that any ordinance, before adoption, must be referred to the planning board for their recommendation. Mrs. Doyle explained that the council must respond because the zoning ordinance must be in concert with the Master Plan. Mr. Gaglia stated that this is the planning board's proposal. The parking ordinance, Mr. Fazen explained, is part of the Master Plan. The Master Plan is what the board recommends.
Mrs. Pournaras asked if the ordinance or the Master Plan creates zones. The ordinances are passed individually with recommendations from the Planning Board. The Master Plan created a Neighborhood Business zone on Talmage Avenue. To be enforceable, it would have to be adopted as an ordinance.
Motion by Mrs. Pournaras, seconded by Mr. Shive, to adopt the Re-examination Report of the Master Plan of the Borough of Bound Brook. Unanimous.
Mr. Fazen reported that Mr. Wyeth (owner of American Cyanamid) held a meeting on March 24. The development of this property has been passed on (golf course and nature preserve) to the county of Somerset for use by the county. Bound Brook and Bridgewater will both be part of these negotiations since the property includes the southernmost part of Bound Brook.
Mr. Sabatino asked if they are going to develop it and then give it away. Mr. Fazen replied that they will develop it and then take a portion of the profits from the golf course to pay for the building of the course.
